End User License Agreement (EULA) | Wheels in Mud 2 : Online

Effective Date: March 7, 2026

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Eivex Interactive ("we", "us") for the mobile game Wheels in Mud 2: Online ("Game").

By downloading, installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, access, or use the Game.

App Store Acknowledgement

This Agreement is between you and Eivex Interactive, not Apple Inc. Apple is not responsible for the Game or its content. To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the Game. Apple is not responsible for addressing any claims relating to the Game or your possession and/or use of the Game. In the event of any third-party claim that the Game or your possession and use of the Game infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of such intellectual property infringement claim. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement and that Apple has the right to enforce this Agreement.

1. License Grant

Eivex Interactive grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game on devices that you own or control, solely for your personal, non-commercial entertainment purposes.

The Game is licensed, not sold, to you. This license does not give you any ownership interest in the Game.

2. License Revocation

Eivex Interactive reserves the right to revoke, suspend, or terminate the license granted to you under this Agreement at our discretion consistent with applicable law, where we reasonably believe that:

You have violated any provision of this Agreement;
You have engaged in conduct that harms the Game, its services, systems, or community;
You have attempted to circumvent, disable, or interfere with security, anti-cheat, or technological protection measures;
You have used unauthorized software, modifications, or third-party tools that interact with the Game;
You have engaged in fraud, refund abuse, exploitation of bugs, or other malicious activity.

Upon revocation of the license, you must immediately cease all use of the Game and delete all copies of the Game from your devices.

Where appropriate and permitted by applicable law, revocation of the license may occur without prior notice. We will make reasonable efforts to provide notice where feasible, unless we reasonably believe that doing so would compromise security, facilitate further violations, or is prohibited by law.

Eivex Interactive may enforce this revocation through account suspension, permanent bans, or other technical and legal measures deemed appropriate and proportional to the violation.

3. Restrictions on Use

You agree NOT to:

Copy, reproduce, distribute, or publicly display the Game or any part thereof;
Modify, adapt, translate, or create derivative works based on the Game;
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game, except to the extent expressly permitted by applicable law notwithstanding this restriction;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
Use the Game for any illegal purpose or in violation of any applicable laws;
Use cheats, exploits, automation software, bots, or any unauthorized third-party software;
Sell, rent, lease, sublicense, or transfer the Game to any third party;

4. Intellectual Property Rights

The Game, including all content, graphics, audio, code, and related materials, is the property of Eivex Interactive and is protected by copyright, trademark, and other intellectual property laws.

All rights not expressly granted to you under this Agreement are reserved by Eivex Interactive.

5. Updates and Modifications

We may provide updates, patches, or modifications to the Game to improve performance, fix bugs, or add features. These updates may be automatically downloaded and installed. We reserve the right to modify or discontinue the Game at any time, where we have a legitimate reason to do so, including technical, operational, or legal reasons, and will provide notice where appropriate.

6. User Data and Privacy

The Game may collect and use personal information as described in our Privacy Policy. By using the Game, you consent to such data collection and use.

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable. For users in the European Economic Area (EEA), the United Kingdom, and Switzerland, additional rights and protections apply as described in our Privacy Policy.

7. Third-Party Services

The Game may integrate with third-party services (such as Google Play, App Store, advertising networks, and analytics providers). These third parties have their own terms and privacy policies, and we are not responsible for their practices or any issues arising from them, including account suspensions by platforms.

8. Third-Party Intellectual Property

Certain elements of the Game may incorporate third-party software, libraries, content, or intellectual property licensed to Eivex Interactive. Such components remain the sole and exclusive property of their respective owners and are used by Eivex Interactive under license.

Your use of the Game is subject to any additional third-party terms that may apply to such components. Eivex Interactive makes no representations or warranties regarding third-party intellectual property and disclaims all liability arising from your use of such components.

All third-party trademarks, service marks, and trade names displayed in the Game are the property of their respective owners.

9. Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EIVEX INTERACTIVE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, such warranties are limited to the minimum extent permitted by applicable law.

Nothing in this Agreement affects your statutory rights as a consumer under applicable law, including rights under EU consumer protection laws relating to digital content and digital services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EIVEX INTERACTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE GAME.

Our total liability to you shall not exceed the amount you paid for the Game (if any) or $10 USD, whichever is greater. Nothing in this Agreement limits or excludes our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be limited or excluded under applicable law.

11. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement, provided that where the breach is capable of remedy, we will give you reasonable opportunity to remedy it.

Upon termination, you must cease all use of the Game and delete all copies from your devices. Sections 2, 3, 4, 9, 10, 13, 14, 16–39, and any provisions which by their nature should survive termination shall survive termination.

12. Governing Law

This Agreement shall be governed by the laws of the Republic of Moldova, without regard to its conflict of laws provisions. Any disputes arising under this Agreement shall be resolved in the courts of the Republic of Moldova, subject to the Dispute Resolution provisions below.

If you are a consumer residing in the European Union, you may also bring proceedings in your local courts, and mandatory consumer protection provisions of your country of residence shall apply.

13. Dispute Resolution

You agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Game shall first be attempted to be resolved through good-faith negotiations.

If the dispute cannot be resolved informally within 30 days, you and Eivex Interactive agree to submit the dispute to binding individual arbitration administered by an independent arbitrator in the Republic of Moldova, unless applicable consumer protection laws in your country provide otherwise.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. This class action waiver does not apply if prohibited by mandatory consumer protection laws in your jurisdiction, such as in certain circumstances under EU law.

For consumers in the European Union, nothing in this section affects your right to bring claims before your local courts or to rely on applicable consumer protection laws.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Eivex Interactive, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Game, violation of this Agreement, or infringement of any third-party rights.

16. Account Ownership

All user accounts created in connection with the Game remain the sole and exclusive property of Eivex Interactive. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use their account solely for personal, non-commercial gameplay purposes in accordance with this Agreement.

Accounts, including any associated in-game progress, virtual items, currency, rankings, statistics, achievements, and other data, have no monetary value and constitute no right, title, or interest in or to the Game or any part thereof.

Prohibited Transfers: You may not sell, rent, lease, trade, gift, transfer, or otherwise dispose of any account or the right to use any account to any third party. Any attempt to do so is void and constitutes a violation of this Agreement. Eivex Interactive reserves the right to terminate, suspend, or take appropriate action against any account involved in an unauthorized transfer, without compensation or prior notice where appropriate.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Eivex Interactive is not liable for any loss or damage arising from your failure to protect your account information.

17. Account Deletion and Data Retention

Users may request deletion of their account and associated personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable. To request account deletion, please contact us at support@eivex.org with the subject line "Account Deletion Request".

Upon account deletion, we will remove or anonymize your personal data, except where retention is necessary for:

Compliance with legal obligations (e.g., tax, accounting, or regulatory requirements);
Fraud prevention, security, and investigation of violations;
Establishment, exercise, or defense of legal claims;
Legitimate business purposes, such as aggregated analytics or performance monitoring, where data has been anonymized.

We will process account deletion requests within a reasonable timeframe and in accordance with applicable law. Please note that certain data may be retained in backup systems for a limited period and will be securely deleted in due course.

Account deletion is irreversible and will result in the permanent loss of all associated in-game progress, virtual items, purchases, and achievements. We recommend that you carefully consider this decision before proceeding.

18. Virtual Items and In-Game Purchases

The Game may include virtual currency, virtual items, or other in-game content ("Virtual Goods") that may be purchased for real money or earned through gameplay.

Virtual Goods have no real-world monetary value and cannot be exchanged for real money, goods, or services outside the Game. All purchases are generally non-refundable, except where required by applicable law or the policies of the platform through which the purchase was made. Refunds, where available, are handled by the platform in accordance with their refund policies and applicable consumer protection laws.

Refund Abuse: If a refund or chargeback is issued for any purchase of Virtual Goods, and we reasonably determine that such refund constitutes abuse of our systems, Eivex Interactive reserves the right to:

Remove the purchased Virtual Goods from your account;
Deduct an equivalent value from your account balance;
Suspend or terminate your account after reasonable consideration of the circumstances;
Restrict future purchases where appropriate.

Abuse of refund systems, including chargeback fraud or purchasing Virtual Goods, using them, and then requesting a refund, may result in suspension of access to the Game. We will consider the proportionality of any action based on the severity and frequency of the violation.

All Virtual Goods are licensed, not sold, and remain the property of Eivex Interactive. We reserve the right to modify, manage, control, or remove Virtual Goods at any time, where we have a legitimate reason to do so, and will provide notice where appropriate.

19. No Guarantee of Progress

Eivex Interactive does not guarantee the availability, accuracy, or permanence of any in-game progress, rankings, statistics, leaderboard positions, achievements, or other user-specific data.

Game progress and associated data may be modified, reset, or removed due to:

Game updates, patches, or technical changes;
Server maintenance, migrations, or failures;
Software bugs, errors, or unforeseen technical issues;
Security incidents or cheating detection measures;
Termination or modification of online services.

We will make reasonable efforts to preserve game data, but we are not liable for any loss of progress, virtual items, or data resulting from any of the circumstances described above. By using the Game, you acknowledge that your in-game progress and achievements are not guaranteed and may be subject to change or loss.

20. User Conduct

When using the Game, you agree not to:

Harass, threaten, bully, or abuse other players;
Post, transmit, or promote any content that is offensive, illegal, discriminatory, or harmful;
Impersonate any person or entity, including Eivex Interactive staff;
Attempt to disrupt or damage the Game servers, networks, or experience of other players;
Use the Game to violate any applicable law or regulation;
Use the Game on rooted, jailbroken, modified, or otherwise compromised devices in a way that may affect security or gameplay integrity.

21. Account Suspension and Ban

Eivex Interactive reserves the right to suspend, terminate, or permanently ban your access to the Game or its online services, where we reasonably believe that you have violated this Agreement or engaged in behavior that we reasonably believe is harmful to the Game, its community, or our business interests.

Where appropriate and feasible, we will provide notice of such actions and an opportunity to appeal, unless we reasonably believe that doing so would compromise security, facilitate further violations, or is prohibited by law. We will consider the proportionality of any action based on the severity and circumstances of the violation.

22. Online Services

The Game may require an internet connection and access to our online servers to function correctly. Eivex Interactive does not guarantee the continuous, uninterrupted, or error-free operation of online services.

We reserve the right to modify, temporarily suspend, or permanently shut down online services (including multiplayer servers) where we have a legitimate reason to do so, including technical, operational, or economic reasons. Where appropriate, we will provide reasonable advance notice of such changes.

Use of online features may require internet access. Your mobile carrier or internet provider may charge you for data usage, and you are responsible for any such charges.

23. Service Availability

Eivex Interactive does not guarantee that the Game or any of its features will remain available indefinitely.

We may modify, suspend, or discontinue any part of the Game, including online features, content, servers, or services, at our discretion for technical, legal, operational, or economic reasons. This includes, but is not limited to:

Shutting down game servers or online functionality;
Removing or disabling certain features, content, or game modes;
Implementing version changes that may affect compatibility;
Region-specific service limitations or restrictions.

Where reasonably practicable and consistent with applicable law, we will provide advance notice of significant service changes or discontinuation. However, we are not liable to you or any third party for any modification, suspension, or discontinuation of the Game or its features.

24. Device Compatibility

Eivex Interactive does not guarantee that the Game will function on all devices, operating systems, or platforms. Compatibility may vary depending on hardware specifications, software versions, manufacturer customizations, and platform updates.

Minimum system requirements, where provided, are recommendations only and do not constitute a guarantee of performance. We are not responsible for any issues arising from:

Insufficient hardware capabilities;
Outdated operating system versions;
Platform or OS updates that may affect compatibility;
Use on modified, rooted, or jailbroken devices;
Network connectivity or performance issues.

You are responsible for ensuring that your device meets the necessary requirements to run the Game. We recommend checking compatibility before downloading or purchasing the Game.

25. Age Requirements

You must be at least 13 years old (or the minimum age required in your jurisdiction to use online services) to use the Game. If you are between the ages of 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Game. By using the Game, you confirm that you meet these age requirements.

If you are a parent or legal guardian permitting a child to use the Game, you agree to be bound by this Agreement and responsible for your child's compliance with its terms.

26. User Generated Content

The Game may allow you to create, upload, post, transmit, or share content, including but not limited to text, chat messages, voice communications, usernames, avatars, vehicle customizations, screenshots, or other materials ("User Generated Content" or "UGC").

By creating or uploading UGC, you grant Eivex Interactive a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, perform, and create derivative works from such UGC in any form, media, or technology now known or later developed, for the purpose of operating, improving, promoting, and providing the Game and related services.

You represent and warrant that your UGC does not infringe any third-party rights and complies with this Agreement and applicable laws. We reserve the right (but have no obligation) to monitor, review, edit, remove, or disable access to any UGC at any time and for any reason, without notice or liability to you.

You are solely responsible for your UGC and any consequences arising from it. We are not responsible for any UGC posted by users.

27. Feedback and Suggestions

If you provide feedback, suggestions, ideas, proposals, bug reports, or other input regarding the Game (collectively, "Feedback"), you grant Eivex Interactive a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable license to use, reproduce, modify, adapt, publish, distribute, display, perform, and incorporate such Feedback into the Game or any other products or services, without any obligation of compensation, attribution, or restriction.

You agree that:

Feedback is provided voluntarily and without any expectation of compensation;
Eivex Interactive is free to use or not use Feedback at its sole discretion;
You waive any moral rights or similar rights in and to the Feedback;
No confidential relationship is established by submitting Feedback.

This license applies to all Feedback, whether submitted through official channels (such as support email, forums, or in-game feedback tools) or through any other means.

28. Beta and Experimental Features

The Game may include beta, experimental, preview, or early access features that are still under development ("Experimental Features"). Such features are provided for testing and evaluation purposes only and may:

Contain bugs, errors, or instability;
Not function as intended or as described;
Be modified, updated, or removed at any time without notice;
Result in data loss or corruption;
Have limited or no security or privacy protections.

By using Experimental Features, you acknowledge and assume all risks associated with such use. Eivex Interactive makes no warranties, express or implied, regarding Experimental Features and disclaims all liability for any damages arising from your use of them. We may, at our discretion, seek feedback on Experimental Features, and any such feedback will be subject to Section 27 (Feedback and Suggestions).

29. No Obligation to Provide Support

Eivex Interactive is not obligated to provide maintenance, support, updates, or customer service for the Game, although we may choose to do so at our sole discretion. Any support we provide is offered on an "as available" basis and does not create any ongoing obligation to provide future support.

If we provide support, including but not limited to technical assistance, bug fixes, or customer service, such support is subject to the terms of this Agreement and may be modified or discontinued at any time without notice. We make no guarantees regarding response times, resolution of issues, or the availability of support personnel.

Any support or updates provided are considered part of the Game and are governed by this Agreement unless separate terms are provided.

30. Anti-Cheat and Security Systems

To maintain fair gameplay, protect the integrity of the Game, and ensure a secure environment for all players, Eivex Interactive may employ automated systems, security technologies, and anti-cheat mechanisms designed to detect cheating, unauthorized software, memory manipulation, data mining, or modifications of the Game.

Scope of Monitoring: To the extent permitted by applicable law, these security systems may analyze, monitor, and collect data related to:

Game files and their integrity;
Memory usage and processes interacting with the Game;
Applications or processes interacting with or attempting to interact with the Game;
Network traffic and communications related to gameplay;
Device identifiers, hardware information, and operating system details;
Performance metrics and error logs for security analysis.

Consent: By installing and using the Game, you expressly consent to the operation of these security technologies for the purpose of detecting, preventing, and mitigating cheating, fraud, unauthorized modifications, and other prohibited activities, to the extent permitted by applicable law. This data collection is conducted in accordance with our Privacy Policy and applicable data protection laws.

Enforcement: If our security systems detect a violation, including the use of cheats, unauthorized modifications, or any tampering with the Game, Eivex Interactive reserves the right to take appropriate action, which may include:

Issuing warnings or temporary suspensions where appropriate;
Termination of your access to the Game where we reasonably believe that you have violated this Agreement;
Removal of in-game progress, virtual goods, or achievements;
Reporting the violation to platform providers (Google Play, Apple App Store) for further action;
Pursuing legal remedies as described in Section 32 (Protection of Intellectual Property).

No Interference: You agree not to interfere with, circumvent, or disable any security or anti-cheat systems in the Game. Any attempt to do so constitutes a material breach of this Agreement and may result in legal action where appropriate.

31. Unauthorized Modifications

You may not modify, alter, patch, translate, adapt, or create modified versions of the Game in any way without the express prior written permission of Eivex Interactive, except to the extent expressly permitted by applicable law.

This prohibition includes, but is not limited to:

Modded Clients: Using or distributing modified versions of the Game client (including APK, IPA, or executable files);
Modified Game Files: Altering, replacing, or adding to Game assets, configuration files, or data files;
Unofficial Patches: Creating or applying any patches not officially released by Eivex Interactive;
Memory Injection Tools: Using tools that inject code into the Game's process or modify the Game's behavior in memory;
Trainers and Cheat Engines: Using software that modifies the Game's performance, grants unfair advantages, or automates gameplay;
Third-Party Launchers: Using unauthorized launchers or platforms to access the Game;
Debugging Tools: Attaching debuggers, monitoring tools, or other software that interacts with the Game's runtime environment.

Consequences: The use of any unauthorized modified version of the Game is a severe violation of this Agreement and may result in:

Immediate and permanent termination of your account and access to the Game;
Removal of all virtual items, progress, and purchases associated with your account;
Legal action for copyright infringement, breach of contract, and violation of intellectual property rights;
Reporting to relevant authorities and platform providers for further sanctions.

Exception: This section does not apply to modifications explicitly authorized in writing by Eivex Interactive or tools provided by us for official modding support. Any authorized modifications must be used strictly in accordance with our guidelines.

32. Protection of Intellectual Property – Misappropriation and Unauthorized Extraction

Eivex Interactive considers any unauthorized extraction, copying, reproduction, distribution, misappropriation, or infringement of the Game's intellectual property, including but not limited to source code, graphics, audio, 3D models, textures, gameplay mechanics, virtual items, or any other proprietary content (collectively, "Game Assets"), to be a severe violation of this Agreement and applicable intellectual property laws.

Prohibited Activities Include, but are not limited to:

Data Mining and Asset Extraction: Using automated tools, scripts, or any other means to extract, scrape, or copy Game Assets from the Game files, memory, or network traffic.
Decompilation and Reverse Engineering: Decompiling, disassembling, or reverse engineering the Game to access, steal, or recreate the source code or proprietary algorithms, except to the extent expressly permitted by applicable law.
Unauthorized Distribution: Sharing, uploading, selling, or otherwise distributing Game Assets (including modded content, ripped assets, or unauthorized copies) through any medium, including websites, torrents, social media, or file-sharing platforms.
Creation of Derivative Works: Using stolen Game Assets to create unauthorized derivative works, clones, or competing products without express written permission from Eivex Interactive.
Server Emulation: Creating, hosting, or using unauthorized third-party servers that emulate the Game's online services or attempt to intercept, modify, or replicate network protocols.
Cheat Software and Exploits: Developing, distributing, or using cheats, hacks, bots, or exploits that interact with the Game in unauthorized ways, which may also involve misappropriation of intellectual property or disruption of services.
Circumvention of Security: Bypassing, disabling, or circumventing any security measures, digital rights management (DRM), or access controls implemented in the Game.
Account Theft and Virtual Goods Theft: Stealing, trading, or selling user accounts or virtual goods obtained through unauthorized means, including phishing, hacking, or exploiting vulnerabilities.

Legal Consequences: Engaging in any of the prohibited activities described above constitutes misappropriation or infringement of intellectual property and a breach of this Agreement. Eivex Interactive will pursue all available legal remedies against violators to the fullest extent permitted by law, which may include:

Civil Liability: Lawsuits seeking damages, including statutory damages, actual damages, and disgorgement of profits obtained through unauthorized use of our intellectual property.
Criminal Prosecution: Referral of the matter to law enforcement authorities for criminal prosecution under applicable laws, including laws against computer fraud, intellectual property theft, and economic espionage.
Injunctive Relief: Seeking court orders to immediately halt the unauthorized activities, including the removal of stolen assets from websites, servers, or other platforms.
Account Termination and Bans: Immediate, permanent termination of access to the Game for any user found to be involved in such activities, without refund or compensation.
Cooperation with Authorities: Full cooperation with local and international law enforcement agencies, including the provision of evidence and information to support criminal investigations and prosecutions.

Enforcement and Monitoring: Eivex Interactive employs technical measures to detect unauthorized extraction, tampering, and other violations of this Agreement. We reserve the right to monitor your use of the Game for compliance purposes, as permitted by law and described in our Privacy Policy.

Enforcement: Eivex Interactive reserves the right to pursue all available legal remedies against individuals or entities that violate its intellectual property rights or this Agreement, including seeking injunctive relief, damages, and other remedies permitted under applicable law.

Reporting Violations: If you become aware of any unauthorized use, distribution, misappropriation, or infringement of Game Assets, or any other violation of this Agreement, please report it immediately to: legal@eivex.org.

33. Prohibition on Artificial Intelligence Training

You may not use the Game or any part of its content, assets, or data for the purpose of developing, training, improving, or operating any artificial intelligence or machine learning systems without the express prior written permission of Eivex Interactive.

This prohibition includes, but is not limited to, the use of Game Assets for training, fine-tuning, validating, or testing any machine learning models, neural networks, large language models, generative AI systems, or similar technologies.

Prohibited AI Uses Include:

Using textures, models, audio, music, or visual assets from the Game to train AI models;
Using gameplay footage, screenshots, or recorded gameplay as datasets for machine learning;
Extracting dialogue, text, or game data for training language models or chatbots;
Using automated tools, scraping software, or data mining techniques to collect Game data for AI datasets;
Creating AI systems that replicate, imitate, or reproduce Game Assets or gameplay mechanics.

Any attempt to collect, extract, or process Game data for artificial intelligence development constitutes a violation of this Agreement and may result in immediate termination of access to the Game, permanent account bans, and legal action where applicable.

All Game Assets remain the exclusive intellectual property of Eivex Interactive and may not be used in datasets, training corpora, or machine learning pipelines without our explicit written authorization.

This restriction applies to both commercial and non-commercial AI systems, including research datasets, academic projects, and automated data collection tools.

34. Force Majeure

Eivex Interactive shall not be liable for any delay or failure in performance resulting from causes outside our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials, failures of the internet or third-party services, cyber attacks, or pandemics.

35. Export Controls and Sanctions

You agree to comply with all applicable export control laws and economic sanctions regulations of the United States, the European Union, the Republic of Moldova, and other relevant jurisdictions. You represent and warrant that you are not located in a country that is subject to comprehensive sanctions or embargoes, and that you are not listed on any restricted party lists, including but not limited to the U.S. Office of Foreign Assets Control (OFAC) Sanctions List, the EU Consolidated List of Persons, Groups, and Entities Subject to EU Financial Sanctions, or similar lists maintained by other relevant authorities.

You may not use, export, re-export, download, or otherwise transfer the Game in violation of any applicable export control or sanctions laws. By using the Game, you acknowledge that you are solely responsible for complying with all applicable export and import laws and regulations.

36. Changes to this Agreement

Eivex Interactive reserves the right to modify or update this Agreement at any time. We will post the revised Agreement on this page and update the "Effective Date" at the top.

For material changes (such as new fees, significant changes to Virtual Goods, or limitations on your rights), we will provide reasonable notice, which may include an in-game notification, push notification, or email to the address associated with your account (if provided). Such notice will be given in advance where required by applicable law.

Your continued use of the Game after the effective date of any changes constitutes your acceptance of the revised Agreement. If you do not agree to the changes, you must stop using the Game.

If required by applicable law, we may ask you to accept the updated Agreement before continuing to use the Game.

37. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Agreement shall remain in full force and effect.

38. Entire Agreement

This Agreement constitutes the entire agreement between you and Eivex Interactive regarding the Game and supersedes all prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the subject matter of this Agreement.

39. No Waiver

The failure of Eivex Interactive to enforce any right or provision of this Agreement shall not be considered a waiver of those rights. Any waiver of any provision of this Agreement will be effective only if in writing and signed by an authorized representative of Eivex Interactive.
